Terms & Conditions in short

  • By ordering any of our services, you agree to be bound by these terms & conditions.
  • All material is guaranteed to be as specified,  but quantities of irrigation heads or zones may vary slightly depending upon field conditions.
  • All work to be completed in a workmanlike manner according to standard practices.
  • Estimates and/or proposals for work are valid for 30 days.
  • Contract acceptance requires a signed estimate along with a 15% deposit.  
  • Payment terms are COD or due upon receipt.
  • Any alteration or deviation from the said specifications involving extra costs will be done only upon a written change order.  The costs will become an extra charge over and above the estimate. 
  • The estimate does not include additional labor which may be required should unforeseen problems arise after the work has started.
  • Events outside Miller Irrigation & Landscape Lighting's control shall be considered force majeure.
  • Miller Irrigation & Landscape Lighting reserves the right to amend any information without prior notice.

Terms & Conditions

This page contains the terms & conditions. Please read these terms & conditions carefully before ordering any services from us. You should understand that by ordering any of our services, you agree to be bound by these terms & conditions.

No other terms or changes to the terms & conditions shall be binding unless agreed in writing signed by us.

Payment

New installations or major renovations require a 15% deposit with the signed contract.  The balance is due upon completion.  Progress payments may be required.  Service work billing is COD or due upon receipt.

Miss Utility

Miller Irrigation & Landscape Lighting is required to make arrangements for Miss Utility to mark utility lines for all participating services (e.g. Comcast, Virginia Dominion Power, etc.).  They require that all animals are restrained and gates remain unlocked during the three day (working days) marking period.  This is required by law in the state of Virginia to prevent loss of life, injuries, damage to property and the environment and economic loss caused by damage to underground utility lines.  In addition, to protect from damage thousands of miles of underground utility lines that provide essential services to Virginia citizens and businesses.  Miller Irrigation & Landscape Lighting must have their own ticket number and cannot dig under any another contractor's ticket.

Private Utilities

You are responsible for clearly marking and advising Miller Irrigation & Landscape Lighting of any private utilities located on your property (e.g. invisible pet fence, drainage system, etc.).  Any required repairs to private utilities resulting from the installation of irrigation, lighting or drainage systems are the responsibility of the homeowner.

Power

Power is to be supplied by others.  A receptacle is required for irrigation controllers and low voltage landscape lighting transformers.

If the receptacle provided is a GFI receptacle, or it is tied into the same circuit as a GFI receptacle located somewhere else, please be aware that when it trips, your controller or transformer will not come on until that GFI receptacle is reset.

Water

Miller Irrigation & Landscape Lighting is not responsible for water quality, water volume or water pressure.  Clients who will be using a well for the irrigation water supply are required to supply us with a current well report upon which we will base our irrigation design.  Any filtration devices deemed necessary after the installation will be an additional charge to be determined.

Force Majeure

Events outside Miller Irrigation & Landscape Lighting's control, which is not reasonably foreseeable, shall be considered force majeure by Miller Irrigation & Landscape Lighting, meaning that Miller Irrigation & Landscape Lighting is released from Miller Irrigation & Landscape Lighting's obligations to fulfill contractual agreements. Example of such events are government action or omission, new or amended legislation, conflict, embargo, fire or flood, sabotage, accident, war, natural disasters, strikes or lack of delivery from suppliers. The force majeure also includes government decisions that affect the market negatively and products, for example, restrictions, warnings, ban, etc.

Additional Information

Miller Irrigation & Landscape Lighting reserves the right to amend any information, including but not limited to prices, technical specifications, terms of purchase and product offerings without prior notice. At the event of when a product is sold out, Vasuma has the right to cancel the order and refund any amount paid in the best way. Vasuma shall also notify the customer of equivalent replacement products if available.

  • Incandescent lamps - one year
  • LED lamps - five years
  • Labor - one year
  • Damage due to act of God (e.g. lightning), power surges, or construction is not covered.

  • Components - two years
  • Labor - one year
  • All material is guaranteed to be as specified, but quantities of irrigation heads or zones may vary slightly depending upon field conditions.
